General Terms and Conditions (GTC) of Falano Port e. U.
Status: February 7, 2025
1. Scope of Application
These General Terms and Conditions (GTC) apply to all contracts concluded via the online shop at https://www.falano-port.com/ between Falano Port e. U., Owner: Christian Gratzl, Kastingerstraße 1, 4863 Seewalchen am Attersee, Austria (hereinafter referred to as "Seller" or "we") and the customers (hereinafter referred to as "Customer" or "you").
2. Conclusion of Contract
(1) The products presented in the online shop do not constitute a legally binding offer, but an non-binding invitation to place an order.
(2) By submitting an order, you are making a binding offer to purchase.
(3) After receiving your order, you will receive an automatic confirmation by email. This confirmation does not yet constitute acceptance of the purchase offer. The purchase contract is only concluded upon an express order confirmation or the shipment of the goods.
3. Prices and Shipping Costs
(1) All prices are stated in Euro (€) and, unless otherwise specified, do not include VAT (small business regulation according to § 6 Abs. 1 Z 27 UStG). Due to system requirements, the tax may appear on the receipt as a 0€ item, which has a purely systemic background and does not mean it is being charged.
(2) Shipping costs are automatically calculated in the shopping cart, if applicable, and displayed before the purchase is completed.
4. Payment
(1) Payment is made via the payment methods offered in the online shop.
(2) The goods remain the property of the Seller until full payment has been received.
5. Delivery and Shipping
(1) Shipping takes place throughout Europe to the address provided by the Customer.
(2) Delivery times may vary depending on the destination country. Generally, the order will be dispatched no later than 14 days after the order is placed and should therefore be delivered within 20 days. Please note that international deliveries in particular may take significantly longer. Please note that this is a legal requirement. As a rule, we ship within a maximum of 4 days with an approximate delivery time visible during the order process, provided by our shipping service provider (Austrian Post).
(3) We generally ship without shipping costs and without tracking. Premium Shipping can be selected during the order process, in which case tracking will be provided. Premium Shipping is free of charge from the order values visible during the order process.
(4) Should delivery be delayed due to force majeure or other unforeseeable events, the Customer will be informed immediately.
6. Right of Withdrawal and Returns
(1) Customers have the statutory right of withdrawal of 14 days.
(2) Returns are only possible if the product is undamaged and unused.
(3) The buyer bears the costs for return shipping without stating a defect. correspondingly secure packaging is required.
(4) To exercise the right of withdrawal, the Customer must inform us in writing within 14 days of receipt of the goods by email to silven.aku@falano-port.com or by mail to Falano Port e. U., Kastingerstraße 1, 4863 Seewalchen am Attersee, Austria. We ask for your understanding that the postal route may take longer.
(5) Unfortunately, we cannot take back personalized products as we cannot put them back on sale. We ask for your understanding.
7. Product Quality
(1) Each notebook is handmade. Therefore, color differences, minor deviations, and stains are possible. These do not constitute a defect.
(2) Each notebook cover is made from grey cardboard and only impregnated and made more resistant with gentle materials. Since the covers are not dyed through for environmental reasons, abrasions may occur on the edges with regular use. These do not constitute a defect.
(3) Every piece of jewelry is handcrafted and may show material-related deviations from one another. However, we stand for the highest quality and ensure it for every product.
8. Warranty and Liability
(1) The statutory warranty provisions apply.
(2) The Seller is not liable for damages resulting from improper use of the products.
9. Data Protection
(1) The processing of personal data is carried out in accordance with our privacy policy on our website.
(2) Customers have the right to access, rectify, or delete their data at any time.
10. Final Provisions
(1) Austrian law applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) Should individual provisions of these1 GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.2
